One such case pending in the Supreme Court (City of Ontario v. Quon) could help create a guide regarding personal vs. professional communication in the workplace.

"Employees in general need to be a lot more careful about what they commit to writing," says Brownstone. "And if they do, they should not use their work computer, because that's a whole different level of privacy."
